This contract is between________________________________ (buyer of pup) and Carefree Labradoodles on the date of ________________.

 

All of our puppies come with the following:

  • Their own folder with all health records
  • Their first shot
  • They have been wormed
  • Avid Microchip
  • They have been vet checked
  • Puppy instructions
  • Registration with Continental Kennel Club or Australian Labradoodle Association of America
  • Health guarantee

Health

 

·        We do everything possible to insure that our pups are healthy and have no genetic defects.

·        We want to make it very clear that although most of our Labradoodles shed little to no hair, we or anyone else cannot guarantee this will apply to your puppy.

·        Seller hereby guarantees that said puppy is believed to be healthy at time of sale and has received appropriate vaccinations and wormings for age. The Buyer has 72 hours to take the puppy to their vet to have them examined. Failure to comply will render any Health Guarantee Null and Void. 

·        If this dog is found to have a hereditary defect which impacts clinically on its quality of life by the age of two years, as certified by a qualified vet at buyer’s expense. Seller has the right to require a second opinion from a nominated veterinarian of seller’s choice at the seller’s expense.

·        All veterinarians must follow the following procedures during the initial examination and the seller’s second opinion examination of defects to the dog.

·        Identification

o       Tattoo number recorded

o       ISO Micro chip scanned and recorded if present

o       DNA Sample taken, sealed and certified forwarded to the seller.

·        Notification

o       The buyer must supply to the seller a veterinarians report indicating possible hereditary defects within seven days of making the first complaint to the seller.

o       A copy of all available reports must be forwarded to the seller for review by their nominated veterinarian if so desired.

o       The seller will review the reports and advise if a second opinion is required and if it is, the seller will nominate a second veterinarian to whom the dog should be taken for further examination or its x-rays and/or reports and reserves the right to have all veterinary reports, X-rays and other tests forwarded to the seller for further review by such parties as the seller may determine and at the cost of the seller.

·        Result

o       The seller will make available all the results from the second opinion to the buyer at which point the following options may be available if the dog is certified to the seller’s satisfaction to have a hereditary defect clinically impacting on its quality of life.

1.      The seller will replace with a puppy/dog of equal or greater value upon the above requirements having been met.

·        It is understood that there may not be a replacement dog available at the time of requested replacement.  The seller is given twelve months to act upon this guarantee.

2.      Or if the Buyer wishes to keep the dog then the Seller will Reimburse the Buyer up to and not exceeding half of the original purchase price of the dog (not including shipping) back to the Buyer.

·        Shipping

o       Buyer bears all costs relating to the sale of the above animal including transportation.  The risk of loss or injury to the above-described animal is on the Buyer at all times after the dog leaves the Seller.

·        Rehoming

o       Buyer agrees that if at any time the buyer wishes to give the dog away, Buyer will give the Seller an opportunity to help in rehoming the dog, which must not be destroyed or relinquished to a pound or shelter.  If the dog dies for any reason, vet report verifying death must be supplied to seller.  Failure to comply with these provisions will render any guarantee null and void.

o       If the dog is resold, the Seller will give the Buyer the amount less any expenses for advertising costs, etc.  If the dog is shipped back to the Seller, it will be at the Buyer’s expense.

·        Buyer Care

o       Any conditions of obesity or malnourishment for any duration will render this Guarantee null and void.

o       The pup must be fed a premium brand of puppy food. 

o       The pup must be kept on a regular schedule of vet visits and be current on all shots and worming's.

 

Spay Neuter Contract

 

The breeding of our dogs without breeding rights is not an option. By purchasing a Carefree Labradoodle, the Buyer hereby agrees to spay/neuter the puppy within the first 6 months and not to breed their Labradoodle. When the spay/neuter of the puppy is complete, send a copy of the document from the vet as proof the puppy has been spayed or neutered.  If you do not provide the documentation within 6 months of puppy’s age, the Health Guarantee will be NULL & VOID.

Definition

The warranty set forth in this contract is the sole warranty and is given in lieu of any and all other warranties, expressed or implied, including warranties of merchantability and fitness for a particular purpose.  The  Buyer’s  sole remedy is under the warranty provision of this contract and the Seller disclaims and will not be liable for any other damages including consequential damages, property damage, emotional distress, loss of use, business interruption or veterinary fees unless specifically set forth in this warranty provision. 

This contract sets forth the entire agreement between the Seller and Buyer and any inconsistent oral terms have no effect on this contract.
